Terms of Use

  1. Introduction
    1. These Terms of Use ("Terms") govern all actions taken by users in relation to the services ("Services") provided by Link-U Technologies Inc. ("Company").
    2. By using the Services, users agree to comply with these Terms.
    3. If a user is a minor, they must obtain prior consent from a legal representative (e.g., a parent or guardian) before using the Services. Additionally, if a minor user continues to use the Services after reaching the age of majority, such continued use shall be deemed as ratification of all actions taken during their minority.
    4. If a user accesses the Services on behalf of a business, the business shall also be deemed to have agreed to these Terms, and the user warrants that they have the authority to bind the business to these Terms.
    5. By accessing or using the Services, users confirm their acceptance of these Terms. Please ensure you read these Terms carefully before using the Services.
  2. Definitions

    In Terms, the following terms shall have the meanings set forth below:

    • "The Company"means Link-U Technologies Inc.
    • "The Site"refers to the website operated by the Company for the service, MANGA Plus Creators by SHUEISHA (mangaplus-creators.jp).
    • "The Services"is the service provided through the MANGA Plus Creators by SHUEISHA the Official Website via the internet.
    • "Content"means any information provided by the Company, or images, text, manga and other content uploaded by users, as well as rights associated with the use of the Services.
    • "Posting"means the act of a user uploading images, text, or other content to the Site or through the Services.
    • "Publication"means the act of making content posted by users on the Site or through the Services accessible to other users.
    • "Intellectual Property Rights"means copyrights, trademark rights, design rights, patent rights, utility model rights, and other intellectual property rights (including the rights to obtain such rights or to apply for their registration).
  3. Scope of Terms

    1. Any other terms, guidelines, policies, or similar documents (collectively, "Supplementary Terms") published by the Company on the Site or through the Services shall form an integral part of Terms.
    2. In the event of any conflict or inconsistency between Terms and any Supplementary Terms, the provisions of Terms shall prevail
  4. Amendments to Terms

    1. The Company reserves the right to amend Terms at its sole discretion when deemed necessary.
    2. When amendments are made, the Company will notify users of the updated Terms and their effective date by posting them on the Site, through the Services, or via other appropriate means.
    3. If a user continues to use the Services after the effective date of the amendments, such use shall constitute acceptance of the amended Terms.
  5. Handling of Personal Information

    The Company shall handle personal information in accordance with its Privacy Policy and applicable laws.

  6. Registration

    1. Users may apply to register an account for the Services by following the procedure designated by the Company and need an account to post or publish the Content on the Services.
    2. Account registration is deemed complete when the Company approves the application.
    3. The Company may refuse registration or re-registration in the following cases and is under no obligation to disclose the reasons for its decision:
      • If the applicant did not apply to register by following the procedure designated by the Company for registering the information.
      • If the applicant is a minor, adult ward, person under curatorship, or person under assistance, and has not obtained the necessary consent from their legal representative, guardian, curator, or assistant.
      • If the applicant intends to use the Services on behalf of a business, and the business has not agreed to Terms.
      • If the applicant has violated Terms or Supplementary Terms in the past, or is connected to such a person.
      • If the Company determines the application to be inappropriate for any other reason.
    4. Users shall promptly notify the Company of any changes to their registered information through the following procedure designated by the Company. Users shall bear any damages incurred due to their failure to notify the Company, as well as any damages suffered by the user or a third party, and the Company shall not be liable for any such damages
  7. Account Deletion and Withdrawal

    1. Users may delete their account and withdraw from the Services at any time by notifying the Company through the method prescribed by the Company.
    2. The handling of user information following withdrawal shall be subject to the provisions of Article 5.
  8. Management of Passwords and User IDs

    1. Users are solely responsible for preventing unauthorized use of their passwords and User IDs and shall take full responsibility for their management. Users must not allow third parties to use, lend, transfer, rename, or sell their passwords or User IDs.
    2. Users shall bear all liability for any damages arising from the use of their passwords or User IDs by third parties, and the Company assumes no liability for such damages.
    3. The Company may, at its discretion, deem any actions performed using a password or User ID to have been performed by the user to whom the password or User ID is assigned, regardless of the reason.
  9. Notifications and Communication

    1. The Company may send emails to users for the purpose of advertising or promoting its own business or the business of third parties.
    2. Users agree to receive such emails as described in the preceding paragraph.
    3. Emails as described in paragraphs 1 and 2 will be sent to the email address that the user registered with the Company.
    4. Notifications or communications provided by the Company through the Site or Services shall be deemed to have been delivered to the user on the day they are posted on the Site or Services. If notifications or communications are sent by email, they shall be deemed to have been delivered when the email is sent.
    5. Users must register an email address with the Company that can reliably be used for communication at all times. If the Company is unable to contact the user due to an issue with the registered email address, the user shall bear any resulting damages, and the Company assumes no liability.
    6. Users must contact the Company through the inquiry form provided on the Site or Services unless the Company specifies another method. The Company does not accept contact via phone or in-person visits.
  10. Account Ownership

    1. Each user may hold only one account. Users are prohibited from holding multiple accounts or sharing an account with others unless explicitly authorized by the Company.
    2. Users may not, under any circumstances, transfer, lend, or otherwise allow third parties to use their accounts.
  11. Maintenance of Usage Environment

    1. Users shall, at their own responsibility and expense, prepare and maintain all devices, software, and communication methods necessary to access and use the Services.
    2. Users must implement appropriate security measures for their usage environment, including but not limited to protection against computer viruses, unauthorized access, and information leaks.
    3. The Company shall not be involved in or bear responsibility for users' usage environments.
  12. User Responsibilities

    1. Users shall use the Services at their own responsibility and bear full responsibility for all actions and outcomes resulting from their use of the Services.
    2. Users shall upload the Content on the Services at their own responsibility, and the Company makes no guarantees and assumes no liability for the Content uploaded by users on the Services
    3. If a user defames others, invades their privacy, discloses personal information without consent, infringes copyrights or other intellectual property rights, or engages in other actions that infringe on third-party rights, or if claims or complaints are brought by third parties, the user shall resolve the matter at their own expense and responsibility. The Company assumes no liability.
    4. Users are responsible for managing, saving, and backing up the content they post on the Services. The Company shall not bear any responsibility for such management, saving, or backups under any circumstances.
  13. Prohibited Actions

    When using the Services, users must not engage in the following actions. If the Company determines that a user has violated these prohibitions, it may take measures including, but not limited to, account deletion, suspension of use, deletion or hiding of content, or suspension of publication:

    1. (1)Actions that violate Terms or other applicable terms.
    2. (2)Actions that violate laws, public order, or morals, or actions likely to do so.
    3. (3)Actions related to criminal activities or actions likely to be connected to criminal activities.
    4. (4)Actions that infringe upon the intellectual property rights, portrait rights, privacy rights, reputation, or credit of the Company or third parties, or actions likely to do so.
    5. (5)Posting sexually explicit, obscene, or violent expressions, or other content likely to cause discomfort to others.
    6. (6)Posting, displaying, or distributing obscene content, child pornography, or child abuse-related content, or content promoting or advertising such materials.
    7. (7)Posting or displaying computer viruses or other harmful programs.
    8. (8)Expressing discriminatory content related to ethnicity, religion, race, gender, age, etc.
    9. (9)Encouraging or promoting suicide, self-harm, drug use, or other harmful behaviors.
    10. (10)Using the Services for the purpose of meeting unacquainted individuals of the opposite sex.
    11. (11)Overloading the network or systems of the Services, or engaging in actions likely to cause such an overload.
    12. (12)Illegally rewriting or deleting information stored on the Company’s systems.
    13. (13)Illegally accessing or attempting to access the Company’s systems or networks.
    14. (14)Impersonating the Company or third parties.
    15. (15)Using another user's ID or password without authorization.
    16. (16)Advertising, promoting, soliciting, or conducting business on the Services without prior approval from the Company.
    17. (17)Posting affiliate links.
    18. (18)Exploiting or abusing bugs or defects in the Services' programs.
    19. (19)Operating, soliciting, or promoting multi-level marketing (MLM), pyramid schemes, chain letters, or similar activities.
    20. (20)Posting links to adult websites, scam sites, or sites distributing harmful software, or directing users to such sites.
    21. (21)Providing benefits or cooperating with anti-social forces.
    22. (22)Hindering the smooth operation of the Services or causing inconvenience to others.
    23. (23)Any other actions deemed inappropriate by the Company.
  14. Suspension of Services

    1. The Company may suspend or interrupt the Services, in whole or in part, without prior notice under the following circumstances:
      1. (1)Routine or emergency maintenance of systems.
      2. (2)System failures, excessive traffic, unauthorized access, hacking, or other incidents.
      3. (3)Natural disasters or other force majeure events, including but not limited to earthquakes, lightning strikes, fires, floods, or power outages.
      4. (4)Any other situations where the Company deems suspension or interruption necessary.
    2. The Company assumes no liability for any damages incurred by users as a result of actions taken under this clause.
  15. Changes and Termination of Services

    1. The Company reserves the right to modify or terminate the Services at its discretion and without prior notice. However, if such changes or termination are expected to significantly impact users, the Company will make reasonable efforts to provide prior notice whenever possible.
    2. The Company assumes no liability for any damages incurred by users as a result of actions taken under this clause.
  16. Intellectual Property Rights

    1. Users represent and warrant that they possess the lawful rights to post content and that such content does not infringe upon the rights of third parties.
    2. Intellectual property rights for the Content uploaded by users shall belong to the users who created it.
    3. Users grant the Company a non-exclusive, royalty-free license to publish, distribute, transmit, and create promotional materials using the Content uploaded by users, both within the Services and on third-party services approved by the Company, for advertising, distribution, and other related purposes.Users may request the removal of their Content, including Content published, distributed, transmitted, or created as promotional materials, and the revocation of the granted license by submitting a request to the Company.
    4. The Company and any party that succeeds to or is granted rights by the Company may modify the Content uploaded by users, such as resizing images, to the extent necessary for the provision and improvement of the Services.
    5. Users agree not to exercise their moral rights against the Company or any third parties authorized by the Company for the purposes outlined above.
    6. Notwithstanding the above provisions, the Company may view, save, or disclose user content (hereinafter referred to as "Viewing, etc.") under the following circumstances:
      1. 7.1. When the Company sends an email to the user's registered email address requesting consent for Viewing, etc., of the content, and one of the following conditions is met: - The user consents to the Viewing, etc. - If the Company does not receive a response from the User by e-mail within seven(7) days of the date on which the Company sent the e-mail requesting consent to view or similar activities, the User shall be deemed to have consented. This provision does not apply in cases of emergency or other unavoidable circumstances.
      2. 7.2. When necessary to identify and resolve technical issues with the Services.
      3. 7.3. When formally requested by a court, police, or other governmental authority under applicable laws.
      4. 7.4. When the Company determines that there is a need to confirm the content of user posts due to violations or potential violations of Terms.
      5. 7.5. When the Company determines that there is an urgent need due to imminent risks to life, health, or property.
      6. 7.6. When necessary for the proper operation of the Site or the Services.
  17. Company's Deletion Authority

    The Company may take disadvantageous measures, such as deleting or suspending the publication of related content, regardless of its legality or adherence to Terms, in the following cases:

    1. If the Company determines that the content is obscene.
    2. If public agencies or specialists (e.g., national or local governments, organizations defined in the guidelines for limitation of liability of specified telecommunications service providers, the Internet Hotline Center, or attorneys) point out that the content violates laws, public order, or third-party rights.
    3. If an individual claiming to be a rights holder provides reasonable evidence that the content infringes their rights, and the Company determines, after careful review, that the individual is the legitimate rights holder.
  18. Suspension of Use and Account Deletion

    1. The Company may, without prior notice, suspend or delete the publication of user-posted content, temporarily suspend the Services for the user, deny account registration, or delete the user’s account in the following cases:
      1. 1.1. If the user violates any provision of Terms.
      2. 1.2. If it is discovered that the user’s registration contains false information.
      3. 1.3. If the user has not used the Services for six months or longer.
      4. 1.4. If the user fails to respond to inquiries or requests within seven days.
      5. 1.5. If the user meets any of the conditions specified in Article 6, Paragraph 3.
      6. 1.6. If the Company determines that the user’s account or continued use of the Services is inappropriate.
    2. The Company assumes no liability for any damages incurred by users due to actions taken under this clause.
  19. Disclaimer

    1. The Company assumes no liability for disputes or issues arising between users or between users and third parties in connection with the Services or related external services.
    2. The Company does not guarantee the legality, accuracy, or other aspects of user-posted content and assumes no liability for it.
    3. The Company has no obligation to monitor, save, or delete user content.
    4. The Company assumes no liability for damages resulting from the suspension, interruption, termination, or unavailability of the Services, the deletion or loss of user-posted content, or account deletion.
    5. If the Company is held liable for any reason, its liability is limited to direct damages, and it shall not be liable for incidental, indirect, special, future damages, or lost profits.
  20. Confidentiality

    Users shall keep confidential any non-public information disclosed by the Company in relation to the Services and designated as confidential unless prior written consent is obtained from the Company.

  21. Transfer of Contractual Position

    1. Users may not transfer, assign, pledge, or otherwise dispose of their contractual position, rights, or obligations under Terms without prior written consent from the Company.
    2. In the event that the Company transfers its business related to the Services to another entity, the Company may also transfer its contractual position, rights, obligations, user registration details, and other customer information to the transferee. Users hereby agree in advance to such transfers, which may include mergers, corporate splits, or other forms of business reorganization.
  22. Severability

    1. If any provision of Terms is found to be invalid or unenforceable under applicable laws, the remaining provisions shall remain fully valid and enforceable.
    2. If any provision is deemed invalid or revoked in relation to specific users, Terms shall remain valid and enforceable for other users.
  23. Language

    1. Terms are prepared in English. Even if Terms are translated into a language other than English, such translation will in no way affect the interpretation of the provisions of Terms. If there is any inconsistency or conflict between such translation and Terms prepared in English, Terms prepared in English will in any case prevail.
  24. Governing Law and Jurisdiction

    1. Terms shall be governed by Japanese law. Any disputes arising in relation to Terms shall fall under the exclusive jurisdiction of the Tokyo Summary Court or the Tokyo District Court as the court of first instance.
